Following the passing of the legislation introducing the SG amnesty, the ATO has released the 'approved form' for taxpayers to make voluntary disclosures to take advantage of the amnesty. It is important to note that employers need to lodge a separate form in relation to each relevant SG quarter.
The six month amnesty period will end of 7 September 2020, which is 6 months after the day the relevant legislation received the Royal Assent.
To be eligible for the amnesty, the ATO indicates that employers need to:
Lodge one approved SG amnesty form for each quarter by 11:59pm on 7 September 2020;
Check amounts are correct and that there are no errors on the forms; and
Complete the declaration to confirm you are applying for the amnesty
The ATO will review the forms and advise employers which quarters are eligible for the amnesty. Taxpayers who have already made disclosures by lodging SG statements since the commencement of the amnesty period (24 May 2018) will not need to lodge the form. The ATO will be contacting these taxpayers to advise of their eligibility for the amnesty and refunding the administration component of payments made.
